Custody Laws

Types of Custody Laws

There are two types of custody in Pennsylvania: legal custody and physical custody.

Physical custody means who the child will live with or spend time with.

Legal custody is what gives parents the right to make decisions on behalf of the child. Parents will usually share legal custody in PA and most parents will have some physical custody.

Pennsylvania custody laws will apply if your child has lived in Pennsylvania for the past 6 months. Custody should be filed in the county where the child has lived for the past 6 months.

Under PA, laws biological parents have certain rights when it comes to custody. In some situations, other people may also be granted custody rights. This can be complicated. Call one of our attorneys to learn more about Pennsylvania’s custody laws.
